Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your use of malcolmshardware.com (the “Site”) and any purchase you make at Malcolm’s Hardware (“Malcolm’s,” “we,” “us,” or “our”) at 44-46 Slipe Road, Cross Roads, Kingston, Jamaica. By visiting the Site or making a purchase, you agree to these Terms.

2. The store and our hours

Malcolm’s Hardware is open Monday through Friday, 8:00 AM to 4:00 PM, and Saturday 8:00 AM to 1:00 PM. We are closed on Sundays and public holidays. Hours are subject to change. The current hours on this Site take precedence.

3. Prices and product availability

• Prices are in Jamaican dollars unless otherwise stated, inclusive of any taxes required by law.
• Prices and stock are subject to change without notice. The price at the counter at the time of purchase is the final price.
• Product images and descriptions on this Site are for illustration. Brands, models, and packaging may vary based on what we have in stock.
• If a product is out of stock when you arrive, we will offer the nearest available substitute or, if applicable, place a special order.

4. Payment

We accept cash, debit, and major credit cards. Trade account customers may also use their line of credit on agreed terms. All sales are final at the time of payment unless covered by Section 5 below.

5. Returns and exchanges

• Unopened, undamaged items in original packaging may be returned or exchanged within 14 days with original receipt.
• Custom-cut materials (pipe cut to length, paint mixed to order if applicable, custom-fabricated items) are non-returnable.
• Bulk materials (cement, sand, blocks, lumber) are non-returnable once they have left the store.
• Defective items are covered by the original manufacturer’s warranty. We will assist with warranty claims where reasonable.

6. Trade accounts

Working contractors, plumbers, electricians, and builders may apply for a trade account. Trade accounts are subject to approval and may include credit limits, payment terms, and discount tiers set in your account agreement. Failure to pay on agreed terms may result in suspension of credit and referral for collection.

7. Delivery

We deliver cement, blocks, lumber, paint, and bulk orders across Kingston and St. Andrew. Delivery is quoted at the time of order based on size, weight, and distance. Delivery times are best-effort and are not guaranteed. Risk passes to you at the point of delivery; please inspect goods on arrival and flag any issues before our driver leaves.

8. Advice given at the counter

Our staff are experienced and happy to share product knowledge. Any advice we give is informational and based on general experience. It is not a substitute for a licensed contractor, plumber, electrician, or engineer where one is required by law for your project. You are responsible for ensuring that any work you do complies with the Building Act, the Kingston and St. Andrew Municipal Corporation requirements, and any other applicable rules.

9. Limitation of liability

To the maximum extent permitted by Jamaican law, our liability for any product or advice is limited to the price you paid for the item. We are not liable for indirect, consequential, or incidental losses, including lost income, project delays, or property damage caused by improper installation. Nothing in this clause limits any rights you have under the Jamaican Consumer Protection Act or other statutes that cannot be excluded.

10. Website use

The Site is provided for informational purposes. Content, including text, images, and structured data, is the property of Malcolm’s Hardware and may not be copied or republished without written permission. You agree not to use the Site to disrupt our systems, scrape data without permission, or impersonate any person.

11. Governing law and disputes

These Terms are governed by the laws of Jamaica. Any dispute will be addressed first by good-faith discussion in person or by phone. If the dispute is not resolved, it will fall within the jurisdiction of the courts of Jamaica.

12. Changes to these Terms

We may update these Terms periodically. The “Last updated” date at the top will reflect any changes. Continued use of the Site or making purchases after a change constitutes acceptance.
