1. Who we are

Malcolm’s Hardware (“Malcolm’s,” “we,” “us,” or “our”) is a family-owned general hardware store at 44-46 Slipe Road, Cross Roads, Kingston, Jamaica. We have operated at this location since 1931. We run the website at malcolmshardware.com.

This Privacy Policy explains what information we collect, how we use it, and the rights you have under the Jamaican Data Protection Act, 2020 (the “DPA”).

2. Information we collect

Most of our business happens in person at the store. We collect very little information online.

  • Website analytics: standard server logs (IP address, browser type, pages viewed) used to keep the website working and improve it. These logs are not used for advertising or sold.
  • Phone and email enquiries: if you call or email us with a question, we keep what you tell us only for as long as needed to answer.
  • Trade account information: if you open a trade account, we hold your business name, contact details, and purchase history for billing and credit management.
  • In-store transactions: when you pay by card, your payment provider (Visa, MasterCard, etc.) handles the card data. We do not store full card numbers on our systems.

We do not currently run a lead-capture form on the website.

3. How we use your information

  • Answer your questions and fulfil your orders.
  • Run trade accounts, including invoicing and credit terms.
  • Keep records required by Jamaican tax law and our insurance.
  • Improve the website and identify which information our customers find useful.

We do not sell your personal information. We do not share it with third parties for marketing.

4. How long we keep it

Trade account records and invoices are retained for at least seven years to satisfy Jamaican tax law and audit requirements. Email and phone enquiries that do not lead to a purchase are deleted within 12 months.

5. Your rights under the Jamaican Data Protection Act

You have the right to:

  • Ask us what personal information we hold about you.
  • Ask us to correct anything that is wrong.
  • Ask us to delete information we no longer need.
  • Withdraw consent for any optional uses you previously agreed to.
  • Lodge a complaint with the Information Commissioner of Jamaica.

6. Cookies

The site uses functional cookies that keep pages working. We do not run third-party advertising or cross-site tracking cookies. Your browser settings let you block cookies if you prefer.

7. Security

We use industry-standard security on our website (HTTPS) and customer database. No system is perfectly secure. If we ever become aware of a breach affecting your information, we will notify you as required under the Data Protection Act.

8. Children

Our website and services are intended for adults. We do not knowingly collect information from children under 16.

9. Changes to this policy

When this policy changes, the “Last updated” date at the top will change. Material changes will be highlighted at the top for at least 30 days.
